AUSTIN, TEXAS: The Council on American-Islamic Relations (CAIR) filed a federal lawsuit against Texas Governor Greg Abbott and Attorney General Ken Paxton. The suit challenges Abbott’s proclamation labeling CAIR as a “foreign terrorist organisation” and banning it from buying land in Texas.

CAIR Challenges Governor’s Proclamation

CAIR’s Dallas–Fort Worth and Austin chapters jointly filed the lawsuit. The organisation argues that Abbott acted without notice, evidence, or a hearing. They claim the move violates both federal and state law.

The petition states that only the U.S. Secretary of State can designate foreign terrorist organisations. CAIR says Abbott’s action oversteps state authority and breaches the Constitution.

Constitutional Rights at Stake

CAIR argues that the proclamation violates its Fourteenth Amendment rights by harming reputation and property. It also infringes the First Amendment by targeting political speech, including CAIR’s criticism of Israeli policies.

Governor Abbott responded on X, stating that the legal challenge would “expose all of their financial activities.” He also directed criminal inquiries into alleged “Sharia courts” in Collin and Dallas counties.

Islamic Mediation Groups Clarify Role

The Islamic Tribunal clarified that it is not a law firm or court. It provides voluntary mediation and arbitration based on Islamic principles. All proceedings comply with federal, state, and local law. Decisions are legally binding only if recognised by state courts.

Muslim, Christian, and Jewish communities frequently use voluntary mediation alongside official courts.

Legal Experts Weigh In

Attorney Charlie Swift called Abbott’s actions unconstitutional. CAIR’s General Counsel Lena Masri noted that the organisation has won previous First Amendment cases against Abbott. CAIR-Texas insists it will continue defending its constitutional rights.

CAIR Seeks Injunction and Damages

The lawsuit seeks to block Abbott’s order and recover damages. CAIR emphasises that it is an independent American nonprofit with no foreign affiliations.

The case has sparked a major constitutional and political debate in Texas. Observers warn it may influence Muslim civil rights nationwide.
